New Delhi, Feb.5 (ANI): Tech giant Apple filed its arguments to the U.S. Supreme Court, discouraging the Apex body from hearing Samsung’s request for review in their ongoing patent infringement dispute with Apple.
Apple further told the highest court that the USD 548 million settlement does not deserve review.
“Samsung’s effort to make this case seem certworthy depends on a made-up narrative in which Samsung, not Apple, is the innovator, despite the overwhelming evidence that Samsung copied the iPhone’s innovative design,” Apple’s attorneys wrote in the filing.
According to recode.net, Apple argued that the method for awarding damages in design patents is a settled issue and not worthy of Supreme Court review.
“Samsung had its day in court – many days, in fact – and the properly instructed jury was well-justified in finding that Samsung copied Apple’s designs and should pay the damages that the statute expressly authorizes. While this litigation may be high-profile, it is legally unexceptional, and Samsung has shown no reason for this Court to prolong it,” Apple said on Thursday. (ANI)
